These Student Terms and Conditions (this “Agreement”) are between you (“Student”) and ed2go, a part of Cengage Learning, Inc. (“ed2go”), regarding your participation in an Advanced Career Training program offered by the partner institution selected by Student (“Institution”). If Student enrolls in multiple programs, the terms and conditions of this Agreement shall apply to each program. This Agreement becomes binding and effective upon Student’s acceptance, indicated by online acknowledgement of receipt of, and agreement to, the provisions of this Agreement.

The parties hereto agree as follows:

1. PROGRAM DISCLOSURES:

a. Student is responsible for reviewing the program description (available on Institution’s website) for the program of Student’s choice prior to enrollment.

b. The program is a non-degree program offered by Institution in partnership with ed2go. Ed2go provides the program’s course and curriculum design, instruction, student evaluation, assessments, and related marketing, communications, and enrollment services. The program may use a consortium delivery model and Student may be enrolled in a program with learners affiliated with Institution and learners affiliated with other institutions. The program is not taught by Institution's faculty. If applicable to the program, career services will be provided by a third-party provider (the “Career Services Provider”) and not by Institution.

c. No promise or guarantee has been made to Student, express or implied, regarding whether the program qualifies for any type of post-secondary credit or the transferability of credits or coursework to another institution. The granting of any type of post-secondary credit for completion of the program is at the sole discretion of Institution and the transferability of any coursework or credit to another institution is at the discretion of such other institution.

d. The program's technology, information, content and other materials (collectively, the "Program Materials") are provided on an “as is” and “as available” basis and may be modified at any time. The Program Materials could include inaccuracies or typographical errors and Institution and ed2go make no representations or warranties of any kind, express or implied, as to the Program Materials.

2. NO JOB PLACEMENT OR SALARY GUARANTEE; CERTIFICATION AND LICENSING DISCLOSURE:

a. Student acknowledges and agrees that neither Institution, ed2go, nor any of their respective employees or representatives has made any promises, guarantees or representations, express or implied, to Student regarding opportunities for Student following completion of the program, including with respect to obtaining a job, internship or externship placement, or earning a specific salary or salary range.

b. Student acknowledges and agrees that neither Institution, ed2go nor any of their respective employees or representatives has made any promises, guarantees or representations, express or implied, regarding Student’s eligibility for any certification or licensure. Student understands that Student may need to meet certain requirements (e.g., work experience requirements) to obtain a particular certification or licensure or employment opportunity and that Student should research the requirements for any certification, licensure or employment opportunity prior to enrolling in the program.

3. NOTICES TO ED2GO: Student shall deliver all notices, requests or other communications required or permitted to be made to ed2go under this Agreement by submitting a support form to ed2go through the ed2go Student Center.

4. TUITION: Tuition or down payment for programs, including any applicable taxes, must be received by ed2go before Student will be registered.

5. COMPLETION REQUIREMENTS: If Student successfully completes the program by the date indicated in the ed2go Student Center, and Student’s tuition has been paid in full, Student will receive a recognition of program completion in such form as Institution may determine. For certain programs, Student may be required to complete certain additional requirements set forth in the program description (e.g., clinical experience) or that are otherwise identified to Student by ed2go or Institution in order to receive a recognition of program completion. Student should review these additional requirements (if any) prior to enrollment. If the program is comprised of multiple courses, Student must successfully complete each course in order to complete the program and receive a recognition of program completion.

If the cost of the program includes a certification exam voucher, Student will receive information on how to obtain the exam voucher upon completion of the program if Student has paid in full the tuition for the program or is current on their financing plan for such tuition.

6. REFUND POLICY: Subject to the terms and exceptions set forth in this Section 6, Student may submit a request to ed2go to cancel their enrollment and receive a refund until the tenth (10th) calendar day after the start date of the program (the “Start Date”) listed in the ed2go Student Center (such period, the “Refund Period”). For refund requests submitted within the Refund Period, Students will receive a refund of one hundred percent (100%) of the tuition amount paid within thirty (30) days following the deactivation date of the program, provided Student returns all course materials to ed2go in as-new condition, at Student’s expense. Such materials must be received by ed2go within ten (10) days following the date provided in the materials return instructions emailed to Student by ed2go. The cost of materials that are not received or cannot be returned (e.g. software, memberships, exam vouchers, exam sponsorship, equipment, etc.) will not be refunded. If Student entered into an installment contract with ed2go for their tuition and Student later requests and is eligible for a refund then ed2go shall cancel such contract and refund any portion of the tuition paid by Student as a down payment within thirty (30) days following the deactivation date of the program.

If Student requests, and is eligible for a refund, and (a) Student’s tuition was paid by Student’s employer or another third-party funding source or (b) Student paid for tuition using Affirm or through a third-party that is not ed2go, the refund amount will be remitted to Student’s employer, Affirm or such third-party, as applicable. Student should consult Student’s employer or the applicable third-party for additional information.

Refund requests made after the close of the Refund Period will not be accepted, unless Student provides ed2go with a written justification during the applicable program’s original access period (not including extensions, transfers or holds), and ed2go and Institution jointly determine, in their discretion, that such justification warrants a refund.

Exceptions to Refund Policy:

Institution’s prior approval is required for a refund to be provided under this Section 6 if Student’s tuition was paid for by a third-party and payment was collected by Institution.

Ed2go’s refund policy shall be superseded by Institution’s if such Institution’s policy is more stringent (e.g. a policy that does not allow for refunds or one that allows fewer days in which to request the refund). Student should consult Institution’s policies and procedures for additional information.

Some programs are non-refundable once Student has received a Start Date. Student is responsible for reviewing the program description prior to enrollment which will state if a program is non-refundable.

For live synchronous boot camp programs powered by Infosec (“Boot Camp Programs”), the following refund policy applies based on when Student notifies ed2go of their request to cancel their enrollment:

  • 30 or more days before the Start Date of the Boot Camp Program:

    • Full refund of the tuition amount

  • 16 to 29 days before the Start Date of the Boot Camp Program:

    • 70% refund of the tuition amount

  • 1 to 15 days before the Start Date of the Boot Camp Program:

    • 30% refund of the tuition amount

  • On or after the Start Date of the Boot Camp Program:

    • Not eligible for refund

Prior to the Start Date of the Boot Camp Program, Student may submit a request to ed2go to reschedule their enrollment in the Boot Camp Program and subject to availability ed2go may grant such request at its discretion. Student requests to reschedule a Boot Camp Program after the Start Date will not be granted.

7. TRANSFER POLICY: Student may transfer from one program to another Advanced Career Training program by submitting a transfer request to ed2go within sixty (60) calendar days of the Start Date (the “Transfer Deadline”), provided that (i) Institution approves such transfer, (ii) Student is current on their existing financing plan (if applicable) and (iii) Student pays any additional fees required in this Section 7. Student may not transfer their enrollment to another person.

If Student requests to transfer to another Advanced Career Training program prior to the Transfer Deadline then the following policy with respect to fees shall apply:

  1. If the program to which Student wishes to transfer costs less than the original program in which Student is registered, Student shall pay a Transfer Fee (as defined below) less an amount equal to the difference between the cost of the original program and the transfer program. To the extent the difference in the cost of the programs exceeds the Transfer Fee, Student shall receive a refund equal to the remaining amount, provided that, if Student entered into an installment contract with ed2go for their tuition, the refund amount shall be applied to reduce the amount outstanding on the contract.
  2. If the program to which Student wishes to transfer costs more than the original program in which Student is registered, Student shall pay a Transfer Fee plus an amount equal to the difference between the cost of the transfer program and the original program plus any applicable taxes.

Student shall be responsible for a non-refundable transfer fee (a “Transfer Fee”) for transferring from one program to another program as follows:

  1. If Student transfers prior to the end of the Refund Period, Student shall not be responsible for a Transfer Fee.
  2. If Student requests a transfer during the period beginning on the eleventh (11th) calendar day after the Start Date and ending on the thirtieth (30th) calendar day after the Start Date, Student shall be responsible for a non-refundable Transfer Fee equal to 25% of the original price of the program that Student enrolled in.
  3. If Student requests a transfer during the period beginning on the thirty-first (31st) calendar day after the Start Date and ending on the Transfer Deadline, Student shall be responsible for a non-refundable Transfer Fee equal to 50% of the original price of the program that Student enrolled in.

If Student is using one of ed2go’s financing options to pay for the program, Student must finalize any new financing within thirty (30) calendar days following transfer approval from Institution.

Exceptions to Transfer Policy:

The preceding transfer policy shall not apply if Student’s enrollment was paid for by a third-party and payment was collected by Institution. In such case, Student may submit a transfer request to ed2go and, if Institution approves the transfer, such transfer will be processed by Student being withdrawn from the program and Student enrolling in a new program through Institution. Student will be responsible for the tuition for the new program which may be paid for by a third-party. If Student’s transfer request is approved, a partial refund for the original program will be returned to the third-party that paid for the program in accordance with the following schedule:

  • If Student submits a transfer request during the Refund Period, a refund equal to 100% of the tuition amount for the original program will be returned.
  • If Student submits a transfer request during the period beginning on the eleventh (11th) calendar day after the Start Date and ending on the thirtieth (30th) calendar day after the Start Date, a refund equal to 75% of the tuition amount for the original program will be returned.
  • If Student submits a transfer request during the period beginning on the thirty-first (31st) calendar day after the Start Date and ending on the Transfer Deadline, a refund equal to 50% of the tuition amount for the original program will be returned.
  • No refund will be provided if Student submits a transfer request after the Transfer Deadline.

If a new version of the program in which Student is registered is released and Student is within the original access period for Student’s current program, Student may transfer into the new version of the program at no cost by submitting a request to ed2go.

If Student enrolled in a Boot Camp Program, the transfer policies set forth in this Section 7 shall not apply and Student may not transfer to another program.

8. EXTENSION POLICY: If Student requires additional time to complete a program, Student may be granted up to two extensions, each equal to twenty-five percent (25%) of the initial duration of access, provided that in no event shall the total access period for the program, including any extensions, exceed one hundred and fifty percent (150%) of the program’s initial access duration. For example, a 12-month program will have two (2) 3-month extensions available, for a total access period of 18 months.

Extension requests must be made to ed2go no later than two (2) weeks prior to the program’s original end date. The cost for extension will be determined using the following table:

“Tuition Fee” as used in the above table refers to the full retail cost listed on Student’s order confirmation at time of purchase. Discounts received will not be taken into consideration when calculating extension costs. Extension fees are non-refundable and taxes may apply.

Exceptions to Extension Policy:

Institution’s prior approval is required for Student to receive an extension under this Section 8 if Student’s tuition was paid for by a third-party and payment was collected by Institution.

If Student enrolled in a Boot Camp Program, the extension policy set forth in this Section 8 shall not apply and Student may not request an extension.

9. HOLD POLICY: A “hold” is a permitted suspension of Student’s participation in the program without penalty. Student may submit a request to ed2go for a hold of up to ninety (90) days which will be granted, in ed2go’s discretion or, if tuition is paid by a third-party, at Institution's discretion, only if Student demonstrates extenuating circumstances. The hold may be taken at once or in individual sessions of thirty (30) or sixty (60) days. If applicable, Student is responsible for making regular finance plan payments throughout the hold period.

Exceptions to Hold Policy:

Institution’s prior approval is required for Student to receive a hold under this Section 9 if Student’s tuition was paid for by a third-party and payment was collected by Institution.

If Student enrolled in a Boot Camp Program, this Section 9 shall not apply and Student may not request a hold.

10. BOOT CAMP PROGRAM CANCELLATION POLICY: If Student enrolls in a Boot Camp Program, ed2go reserves the right to cancel the Boot Camp Program or modify the Boot Camp Program’s schedule at any time. If the Boot Camp Program is canceled or the Boot Camp Program’s schedule is modified, ed2go will notify Student at the email address provided by Student. If the Boot Camp Program is canceled or Student is no longer able to attend due to a schedule modification made by ed2go, Student may elect to reschedule for another cohort of the Boot Camp Program, subject to availability, or receive a refund of all tuition paid by Student.

11. STUDENT SUPPORT: Ed2go’s normal hours of operation are Monday through Friday, 8:00am to 5:00pm Pacific Time. Student should expect to receive responses from an ed2go representative and/or program facilitator within one business day, Monday through Friday.

12. STUDENT CONSENT TO RELEASE OF DATA: Student authorizes Institution and ed2go to share information about Student and Student's participation in the program with each other and, if applicable, to Student’s referring counseling center to facilitate and administer the program. In addition, if applicable, Student authorizes Institution and ed2go to share information about Student and Student's participation in the program to the Career Services Provider to permit such provider to provide career services to Student.

If Student's enrollment in a program relates to a third-party certification examination and Student participates in the third-party certification examination, Student hereby authorizes (a) the third-party certification body and its authorized testing provider(s) to release Student's name and certification result ("Student Exam Results") to Institution and ed2go; and (b) Institution and ed2go to collect, use, store, and transfer Student Exam Results in connection with: researching, developing, or improving its products or services; public aggregated reporting of pass/fail rates; and compliance reporting. Student hereby authorizes Institution and ed2go to provide Student Exam Results to third parties if: (x) Institution or ed2go deems such disclosure necessary for the purposes authorized in clause (b) of the preceding sentence and (y) Institution or ed2go believes in good faith the disclosure is required by law, such as to comply with a subpoena, warrant, court order, or similar legal or administrative process.

13. MESSAGING AND RECORDING NOTICE:

Messaging and Recording Consent

Student expressly consents, as permitted by applicable law, to ed2go, or its affiliates, contacting Student via prerecorded or artificial voice messages, text messages, automatic dialing systems, and to the monitoring and recording of telephone calls for quality assurance, training, and compliance purposes. Such communications may be sent to any telephone number provided by Student or obtained by ed2go in accordance with applicable law, including mobile numbers, even if charges apply to Student.

Images and Recordings in Boot Camp Programs

If Student participates in a Boot Camp Program, ed2Go may capture photographs, video recordings, and/or audio recordings that may include Student. Such images and recordings may constitute Student’s Personal Information (as defined in ed2go’s Privacy Notice) and will be collected and used in accordance with ed2go’s Privacy Notice and applicable law.

Student grants ed2go a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such images and recordings solely for legitimate educational, operational, and promotional purposes related to ed2go’s services and programs, including publication on ed2go’s, Institution’s, or their respective affiliates’ websites or marketing materials.

Nothing in this section transfers ownership of Student’s name, likeness, voice, or other personal attributes to ed2go. Student retains all rights in their Personal Information and may withdraw consent for future marketing uses in accordance with ed2go’s Privacy Notice and applicable law, to the extent such withdrawal is feasible.

14. Authorization to Obtain and Share Employment and Wage Outcomes Information

By enrolling in this program and providing your Social Security number, you acknowledge and agree that ed2go, Institution, and their respective service providers may collect and verify information about your employment and earnings outcomes for the purpose of evaluating program effectiveness, fulfilling regulatory reporting obligations, and improving educational programs. Employment and wage information obtained pursuant to this authorization will be used solely for educational outcomes reporting, research, and/or regulatory compliance purposes and will not be used to determine your eligibility for employment.

You authorize ed2go and Institution to use your Social Security number to obtain information about your employment status, employer information, and wage or income data from third-party sources, including consumer reporting agencies such as Equifax, or other employment and income verification services. Ed2go collects your Social Security number solely to obtain this information and for no other purpose.

You understand that such information may constitute a consumer report under the Fair Credit Reporting Act (15 U.S.C. §1681 et seq.).

By agreeing to this authorization, you:

  • Provide written authorization for ed2go and Institution to obtain employment and wage verification data from consumer reporting agencies.
  • Authorize the use of this information for educational outcomes measurement, regulatory reporting, institutional research, accreditation, and program improvement purposes.
  • Consent to the collection of this information by ed2go and Institution and sharing with relevant accrediting bodies or governmental agencies where required by law or regulation.

Information collected under this authorization will be processed on behalf of Institution and in accordance with ed2go’s Privacy Notice.

This authorization will remain in effect for 3 years following completion or withdrawal from the program, unless revoked in writing where permitted by law.

15. GROUNDS FOR TERMINATION: Ed2go may terminate Student’s enrollment should Student fail to comply with (a) this Agreement, or (b) any ed2go rules or policies of which Student has been made aware. In addition, if Student owes any amount on a finance plan from ed2go and is delinquent on Student’s finance plan payments or installments for more than ninety (90) days, ed2go reserves the right to terminate Student’s access to the program without a refund.

16. ARTIFICIAL INTELLIGENCE (AI): The use of generative AI has become increasingly prevalent in various aspects of everyday life. When completing course assignments, you are required to submit your original work. Plagiarism or utilizing generative AI to complete your assignments is strictly prohibited and may result in consequences, including being dropped from the course or receiving a deduction from your score based on the grading rubric. While using AI for research purposes is acceptable, it is essential that the work you submit is your own and does not infringe upon copyright or academic integrity guidelines.

17. INTELLECTUAL PROPERTY

The program consists of text, images, videos, audio clips, software and other content ("Content"), all of which are owned or licensed by ed2go or its affiliates. Content is protected by U.S. and international copyright laws. Ed2go, its affiliates and licensors retain all proprietary rights in Content, and, except as expressly set forth in these terms, no rights are granted to any Content, other than as necessary for Student to view, attend, and participate in the program. All Content is for general informational purposes only. Ed2go reserves the right, but does not have any obligation to monitor, edit, modify or remove any Content, in its sole discretion, at any time for any reason or for no reason at all.

18. LIMITATION ON DAMAGES

NEITHER INSTITUTION, ED2GO, NOR THEIR RESPECTIVE EMPLOYEES OR REPRESENTATIVES WILL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOST PROFITS, LOST DATA, OR LOSS OF REVENUE. WITHOUT LIMITING THE FOREGOING, INSTITUTION'S AND ED2GO'S AGGREGATE MAXIMUM LIABILITY FOR ANY DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE PROGRAM, WHETHER IN CONTRACT, TORT OR OTHERWISE SHALL BE LIMITED TO THE AMOUNT PAID BY STUDENT UNDER THIS AGREEMENT. THE LIMITATIONS IN THIS SECTION SHALL APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

19. GOVERNING LAW AND JURISDICTION FOR DISPUTES: This Agreement shall be construed and enforced in accordance with the laws of the State of New York, without regard to its conflict of law provisions which would require the application of the laws of another jurisdiction. Any suit, action or proceeding arising out of or relating to this Agreement may be commenced and maintained only in any state or federal court of competent subject matter jurisdiction in New York County, New York, and each Party waives objection to such jurisdiction and venue. The parties expressly, knowingly and voluntarily waive any right to a trial by jury in any proceeding arising out of or relating to, and/or to enforce this Agreement.

20. MISCELLANEOUS:

This Agreement constitutes the entire agreement between Student and ed2go with respect to the program and supersedes all prior or contemporaneous proposals, communications, understandings or agreements. This Agreement may not be modified except by written agreement of Student and ed2go. Student may not assign this Agreement or its rights or obligations under this Agreement. The failure of either party to enforce its rights under this Agreement at any time for any period will not be construed as a waiver of such rights. Institution is a third-party beneficiary to the provisions of this Agreement that are for the benefit of Institution.

21. STUDENT AGREEMENT:

Student understands that this is a legally binding agreement and that Student’s online acceptance of this Agreement is confirmation that Student has read, understood and agreed with Student’s rights and responsibilities. Further, Student certifies that Student understands the cancellation and refund policies and that Student agrees to these policies.
